What is brand renewal?

What is the trademark renewal procedure in India?

The trademark renewal process can be done in India in two ways: either to request renewal and exchange a part of the trademark with it, or to renew the trademark registration without changing the trademark.


The renewal application is submitted on the TM-12 form and can be submitted by a registered owner or an officer approved by the registered trademark owner. The renewal procedure will be requested after the expiration date for trademark restoration by submitting the TM-13 form and the specified quota of INR 5000.


However, this application can only be filed if it has not expired one year after the expiration date of the trademark. After the approval of the trademark restoration application, the registrar publishes the trademark in the Trademark Journal and, in the event that the owner recovers the trademark, in the event that there are no objections from third parties. However, in the event of a complaint, the brand owner can object to the complaint and claim their brand.
